




REGULATIONS
Woodpecker Mount Management Ltd
1 – 149 Woodpecker Mount including 1 – 12 Templar Court
Regulations as they relate to Lessees’ use of 1 bedroom flats, 2 bedroom maisonettes, and Garages “the Premises” in pursuance of Woodpecker Mount Management Ltd. (“The Manager” of Woodpecker Mount “The Estate”) Memorandum and Articles of Association.
These regulations supplement existing covenants and contracts between the “Lessee” and Manager and do not replace them.
Regulations as they relate to Freehold houses.
Regulations as they relate to amenity land and road where applicable.
Part 1 – Flats and maisonettes.
A In this schedule “Building” shall mean the building of which the flat or maisonette form part.
B “Common Parts” shall mean the common parts of the Building where appropriate.
1 Not to use or suffer the use of the Premises for any other purpose than that of a single household and the garaging of a private motor vehicle. Garages are not to be let separately from a flat or maisonette.
2 Not to do or suffer to be done any act or thing causing nuisance or annoyance to the Manager or the Owners, Lessees and Occupiers of the other Flats or Maisonettes comprised in the Building nor use the Premises or suffer their use for any illegal or immoral purposes.
3 Not to display any plate placard advertisement or board of any kind.
4 Not to fix any aerial or object or wires to the roof of the Building(s) or the outside of the Premises. With permission of freeholder an aerial or dish can only be fixed to brickwork and not to any other surface and in a position agreed with "the manager". Any approved external wiring must be coloured black or brown only.
5 Not to obstruct or permit the obstruction of any of the passages landings or staircases in the Building or the driveway or forecourts or the footpaths on the Estate. Neither Common parts nor grassed or paved areas or driveways are to be used for storage of any item.
6 Not to play or permit the playing, (nor fixing to any wall at any time), of any musical instrument, stereo, television, radio, loudspeaker or mechanical or electrical or other sound producing or reproducing apparatus or machine of any kind in the Premises

a between the hours of 10.00pm and 8am so as to be audible outside the Premises or in the Common Parts.
b at any other time or times so as to cause any nuisance or annoyance to any other lessees, owners, or occupiers of the Premises and for the purposes hereof the decision of the Manager (or an agent appointed by the Manager for the purposes of this paragraph) shall be final and binding on the parties.
and to keep all floors covered with close carpeting or other sound deadening material. For avoidance of doubt laminate type flooring is not permitted.
c To remove forthwith upon so being required by the Manager any object or obstruction or waste in the Common Parts or grassed or paved areas and to pay to the Manager or his agent on demand the cost incurred in removing and if appropriate storing the same which removal and storage is expressly authorised and shall be at the Lessee’s risk.
d Repairs to property are to be carried out with minimum disturbance to neighbours and no noise or vibration in connection with repair work is permitted on a Sunday or after 2pm on a Saturday or after 7pm Monday to Friday.
During repair work to flats, communal walls are not to be damaged, and communal carpets are to be protected at all times from dust and debris and are to be cleaned on completion of repair work.
7 At all times when not in use to keep shut the dustbin store doors and any underground garage gate. Loose storage is not permitted outside a property.
8 To refer any dispute difference or complaint that may arise between the Lessee and the Lessee or occupier of any other part or parts of the Building in respect of the use or occupation of the Premises or any other part of the Building to the Manager’s managing agent before taking any further or other steps or proceedings in relation thereto.
9 Not to throw dirt rubbish rags or other refuse or suffer the same to be put into sinks, baths, lavatory cisterns or waste or soil pipes, or out of windows in the Flat or Maisonette and not to block or suffer same to be blocked/ overflow.
10 No clothes or other articles shall be hung or exposed outside the Premises.
11 To keep the Premises (including any balcony railings) and everything attached thereto and used solely in connection therewith in good and substantial repair and condition and in 2012 to;
i repaint in white with both undercoat and top coat as necessary the balcony railings (if any) and the outside of timber and metal window frames.
ii repaint in such colour as shall be in harmony with nearby garage doors the outside wood and metal work of the Garage
and; in every fourth year thereafter to the Manager’s reasonable satisfaction
12 To keep window glass of the Premises (including balcony frame windows where appropriate) properly repaired and cleaned. Window glass is not to be repaired/replaced by plastic.
13 Not to leave any loose boxes parcels newspapers or any inflammatory material in the Common Parts or bin stores or gardens and to keep waste properly enclosed and as required by Croydon Council and/or the manager.
14 To comply with the Manager’s request to observe these regulations and to pay £75 per letter written by the Manager thereafter in requesting or enforcing compliance with these regulations and any subsequent costs that follow from non-compliance.
15 Not to use landscaped grounds for primary access to or egress from a flat or maisonette. Amenity land is not to be used for ball games.
16 To observe parking regulations as displayed from time to time on Woodpecker Mount. Permits must be shown at all times. All vehicles must be taxed, insured and maintained in a roadworthy and lawful condition.
Commercial vehicles are not allowed on Woodpecker Mount but if attending property on Woodpecker Mount for repair and maintenance purposes they may do so between 07.00 and 19.00 Monday to Saturday and must display a visitor’s permit and clearly state the address of the property being attended, and the reason, in the vehicle’s front windscreen. Failure to do so will result in the issue of penalty notice.
Vehicle engines are not to be left running on any part of the Estate.
17 Parking spaces on Woodpecker Mount are for temporary use by visitors’ cars. Residents’ cars should be parked in their garages. Until further notice residents may use the visitors parking areas and display a resident’s permit. Nuisance - including storage of a vehicle, obstruction and non- temporary parking – will result in the issue of a penalty notice.

Visitors’ parking is subject to the Manager’s discretion but is not more than 3 continuous nights duration in any 28 day period anywhere on Woodpecker Mount.
18 Building skips are not allowed on Woodpecker Mount without prior permission of the Manager. Storage of builder's materials is prohibited in common parts of flats and outside any front door.
19 Dogs to be kept on leads and must not be allowed to foul amenity land.
20 To comply with London Borough of Croydon private rented property scheme if appropriate.
21 Not to alter the external appearance of the property, nor injure the walls or roofs, without the prior consent of the freeholder and the Manager.
22 Without prejudice to the generality of the foregoing to observe and perform all regulations made by the Manager from time to time relating to the Estate.
Part 2 Freehold houses and garages. (the premises).
1 Not to use or suffer the use of the Premises for any other purpose than that of a single household and the garaging of a private motor vehicle. Garages are not to be let separately from a house.
2 Not to do or suffer to be done any act or thing causing nuisance or annoyance to the Manager or the Owners, Lessees and Occupiers of the other Flats or Maisonettes or Houses comprised in the Estate nor use the Premises or suffer their use for any illegal or immoral purposes.
3 Not to display any plate placard advertisement or board of any kind and to keep waste properly enclosed and as required by Croydon Council and/or the Manager.
4 Not to obstruct or permit the obstruction of any of the passages landings or staircases on the Estate or the driveway or forecourts or the footpaths on the Estate. Neither Common areas nor grassed or paved areas or driveways are to be used for storage of any item.
5 Not to throw dirt rubbish rags or other refuse or suffer the same to be put into sinks, baths, lavatory cisterns or waste or soil pipes, or out of windows in the house and not to block or suffer same to be blocked/ overflow.

ii if not repainted by the Manager, repaint in such colour as shall be in harmony with nearby garage doors the outside wood and metal work of the Garage.
in every fourth year thereafter to the Manager’s reasonable satisfaction.
7 Not to play or permit the playing, (nor fixing to any party wall at any time), of any musical instrument, stereo, television, radio, loudspeaker or mechanical or electrical or other sound producing or reproducing apparatus or machine of any kind in the Premises

b at any other time or times so as to cause any nuisance or annoyance to any other lessees, owners, or occupiers of the neighbours and for the purposes hereof the decision of the Manager (or an agent appointed by the Manager for the purposes of this paragraph) shall be final and binding on the parties.
c To remove forthwith upon so being required by the Manager any object or obstruction or waste associated with the premises from the amenity land or grassed or paved areas and to pay to the Manager or his agent on demand the cost incurred in removing and if appropriate storing the same which removal and storage is expressly authorised and shall be at the Lessee’s risk.
8 Not to use landscaped grounds for primary access to or egress from a house. Amenity land, including roads, is not to be used for ball games.
9 Not to alter the external appearance of the property without the prior consent of the Manager. For the avoidance of doubt, window glass is not to be replaced or repaired in plastic and any fencing is to first be approved by the Manager.
